JUSTICE AMARESH KUMAR LAL ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406 of IPC and 3⁄4 of D. P. Act.

Allegation is that Rs.1,00,000/- was given to the petitioner by the informant and later on Rs.50,000/- was given to accused Kiran Devi, the sister of the father of petitioner. Further Rs.2,00,000/-, a motorcycle and other articles were demanded by the accused persons and lastly, marriage was not performed. It is submitted that the petitioner has not demanded any money. Other co-accused has been granted anticipatory bail by the learned Sessions Judge. The petitioner has no criminal

It is further submitted that allegations are vague. The informant's son is married with the grand-daughter of Yugal Rai. The informant had demanded money as a help for the purpose of marriage of his niece, which was not fulfilled. Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioner will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in Bidupur P. S. Case No. 103 of 2014, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:- (i) The petitioner will not indulge himself in similar or any other offence.

(ii) One of the bailors must be the close relative of the petitioner.

(iii) The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be
