Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
The rice was recovered from the co-accused Arun Sah, Bam Bahadur Sah and Badri Chaudhary who claimed that they purchased these rice from the petitioner being PDS dealer. Hence, it was suspected that the rice of Aantoday and B.P.L schemes were sold in the black market. It is submitted by learned counsel for the petitioner that subsequently the stocks of the petitioner were verified by the Circle Officer when no misappropriation was found and admittedly without verifying the stocks the First Information Report was lodged.
Patna High Court Cr.Misc. No.32512 of 2014 (3) dt.11-02-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 247 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
