JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 Heard the learned counsel for the petitioners, complainant/opposite party No. 2 and the State. The petitioners seek bail in anticipation of their arrest connection with Complaint Case No. 1268 of 2017 in which cognizance has been taken under Sections 379, 504 and 506 of the Indian Penal Code.
Patna High Court Cr.Misc. No.66458 of 2018(2) dt.14-12-2018 2/3 The petitioners are alleged to have made attempts of taking away the motor pump of the complainant/opposite party No. 2. When that was detected and a protest was made, the complainant/opposite party No. 2 was divested of ten thousand rupees which he was carrying with him. It has further been alleged that petitioner No. 2 had demanded a rangdari of Rs. 50,000/-.
The learned counsel for the petitioners has submitted that the complainant/opposite party No. 2 is an Advocate and there is difference in the statement made in the complaint petition and in his solemn affirmation. Regard being had to the nature of accusation in the complaint petition, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Banka, in connection
