In this case, the petitioner is seeking anticipatory bail in connection with C2A Case No. 41 of 2020 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act.

The matter relates to recovery of 17.250 litres of liquor. Looking to the quantity of liquor and the petitioner has no criminal history, let the petitioner above named, in event of arrest or surrender before the court below within six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Excise Court,

No.31634 of 2020(2) dt.02-03-2021 2/2 Hajipur, Vaishali in connection with C2A Case No. 41 of 2020, subject to condition as laid down under section 438 (2) Cr.PC and further condition is that one of the bailors of the petitioner shall be his close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of his bail and the court below will take decision in accordance with law.
