The petitioner seeks bail in Madhepura (Bharahi OP) P.S. Case No. 584 of 2020, registered for the offence punishable under Sections 307, 302 and other allied sections of the Indian Penal Code.

As per the FIR, this petitioner is alleged to have assaulted with iron rod on the head of Dheeraj Kumar (nephew of the informant). It is further alleged that all the accused persons caught hold of Sonu Kumar son of informant and coaccused Nitish gave Dabia blow on the head causing death of son of informant.

There is no injury report of Dheeraj Kumar on record. Petitioner is not the assailant of the deceased. There is delay of 11 days in lodging the FIR without any plausible explanation.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharahi OP) P.S.
