JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 353 and some other ancillary Section of the Indian Penal Code and u/s 46/47 of Jail Act.

As per the prosecution case, this petitioner along with other accused persons, who were in jail, were making slogans against the jail administration and abusing the informant and others.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that allegation of firing is against other accused persons and petitioner is only alleged to be member of unlawful assembly. Petitioner is in custody since 30.07.2020 and

Patna High Court CR. MISC. No.41651 of 2021(2) dt.03-01-2022 2/2 investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Saharsa in connection with Saharsa Sadar PS case No.481/2020.
