The petitioner has challenged the order dated 23.08.2012 passed by the learned Judicial Magistrate, Ist Class, Banka in Complaint Case No. C-363 of 2012, whereby cognizance has been taken under Section 138 of
Patna High Court CR. MISC. No.13716 of 2015(3) dt.08-05-2019 2/2 the Negotiable Instruments Act.
The learned counsel for the petitioner is not in a position to inform this Court about the stage of the case. However, since the order of cognizance has been passed in the year 2012, this Court is not inclined to interfere with the same.
In case, the trial of the petitioner has not concluded, the petitioner would have the liberty to avail of the remedies available to him under law.
With the aforesaid observation/direction, the petition is dismissed.
