The petitioner seeks bail in Kateya P.S. Case No. 230 of 2018, registered for the offence under Section 302/34 of the Indian Penal Code.

As per the prosecution case, the F.I.R. named accused persons got executed Basiyatnama for the entire land of uncle of informant in their favour and thereafter, killed him to grab the entire land.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation. Only suspicion has been raised against him. Only material, which has come against petitioner, is that he is brother-in-law of coaccused Girish Rai and informant and he helped co-accused Girish Rai in bringing the dead-body from Gopalganj. Petitioner is in custody since 11.04.2021.

Patna High Court CR. MISC. No.41609 of 2021(2) dt.17-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Kateya P.S.
