APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 01-08-2019 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code registered in connection with Nayaram Nagar P.S. Case No. 216 of 2018.
3. It is submitted that the petitioner has been falsely implicated in the backdrop of petty dispute and there is case and counter case between the parties. The petitioner's father had lodged the FIR in Nayaram Nagar P.S Case No. 202 of 2018 against the informant and other persons prior to the present FIR. The prosecution story is doubtful considering that one injured person has been treated at Munger while the other injured person has been treated at Bhagalpur. The petitioner claims clean antecedents.
4. Learned APP opposes the petition, submitting that injured Sunil Kuwar has been treated at Bhagalpur after being referred from Munger. The said Sunil Kuwar has suffered grievous injury attributed to the assault by the petitioner.
