This is 2nd attempt for grant of bail on behalf of petitioner in Ara Nagar P.S. Case No. 562 of 2018 registered for the offence under Sections 341, 323, 504, 506, 379, 386/34 of the I.P.C. Earlier, the prayer for bail of petitioner was rejected, vide order dated 20-11-2019 passed in Cr.Misc. No. 64626 of 2019 (Annexure - 1 to the bail petition).

On last occasion, vide order dated 05-12-2020, a report was called for from the court below regarding stage of the trial, which has been received and kept at flag 'A'. From perusal of report of learned Chief Judicial Magistrate, Bhojpur at Ara, as contained in Letter No. 01/2021 dated 02-01-2021, it appears that in this case, charge has already been framed on 12-12-2019

Patna High Court CR. MISC. No.31045 of 2020(3) dt.06-01-2021 2/2 and after framing of charge, three prosecution evidence have already been examined.

Considering the aforesaid facts and circumstances, the bail application of petitioner is again rejected. However, since the petitioner is in custody since 26-06-2019, the learned Trial Court is directed to conclude the trial as early as possible. (Prabhat Kumar Singh, J.) anay/- U T
