JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 324, 307, 447/34 of the Indian Penal Code. As per allegation in the F.I.R, an altercation took place between both the parties due to ancestral property. All the accused persons including the petitioners assaulted the informant and her son by means of danda , sword and knife. Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. There is case and counter case between the parties. General and omnibus

Patna High Court CR. MISC. No.42373 of 2021(2) dt.23-03-2022 2/2 allegation levelled against the petitioners. From perusal of the injury report, the injury was simple in nature caused by hard and blunt substance.

Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioners, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, -VI, Patnacity, Patna in connection with Gaurichak P.S.Case No. 334 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
