Revision No 228 of 2015, an order dated 07.02.2015, passed by the learned Principal Judge, Family Court, Aurangabad in Miscellaneous Case no. 42 of 2011, whereby the petitioner was directed to pay a sum of Rs. 7,000/- per month as maintenance allowance was affirmed. While rejecting the revision application, this Court had taken into account the earning of the petitioner through a Pathological Centre, which he was admittedly running at Goh in the district of Aurangabad. Patna High Court CR. MISC. No.71582 of 2018(2) dt.03-04-2019 2/2 does not have any source of earning and, therefore, this Court's judgment dated 10.03.2017 should be modified. In my view, the petitioner has remedy under Section 127 of the Cr. P.C. to apply for alteration of the amount of compensation in the changed circumstance, which he can avail. This application is disposed of with the observation, as above.
