2. Learned counsel appearing on behalf of the petitioner submits that the petitioner is 69 years old lady. She is illiterate and not able to understand the queries made by the Executive Engineer, Rupankan Pramandal, Aurangabad (respondent no.4) for expeditious payment of revised pension to her, which has already been sanctioned and authorized by the Accountant General (Bihar).

3. Learned counsel appearing on behalf of the State

Patna High Court CWJC No.7824 of 2023(2) dt.22-08-2023 2/3 submits that the Executive Engineer, Rupankan Pramandal, Aurangabad is duty bound to take steps to make payment of the retiral dues as claimed by the petitioner after giving financial upgradation on account of time bound promotion and ACP, which was required to be paid to the deceased employee, namely, Mahamad Ibrahim, who had retired from the post of Manson in the office of the Executive Engineer, Rupankan Pramandal, Aurangabad.

Considering the submissions made on behalf of the rival parties, the Executive Engineer, Rupankan Pramandal, Aurangabad is directed to ensure to get all the formalities done by deputing a competent Officer posted under his jurisdiction as the petitioner is 69 years old woman, illiterate and not able to understand the queries made for grant of such benefit in accordance with law.

5. The above order must be carried out by the Executive Engineer, Rupankan Pramandal, Aurangabad within a period of three weeks from the date of communication of this order and ensure that the petitioner is not harassed by making such communication and not providing any assistant to her.

6. In case the petitioner finds that the Executive Engineer, Rupankan Pramandal, Aurangabad has not redressed

Patna High Court CWJC No.7824 of 2023(2) dt.22-08-2023 3/3 her grievance and acted upon in accordance with the direction of this Court, the petitioner is at liberty to take appropriate legal action against the Executive Engineer, Rupankan Pramandal, Aurangabad.

7. With the above observation/direction, the present writ petition is disposed of.
