2. Petitioner seeks regular bail in connection with Basantpur (Lakri Nabiganj O.P.) P.S. Case No. 667 of 2025 registered for the offences punishable under Sections 103 and 3(5) of the Bharatiya Nyaya Sanhita.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is innocent and he has falsely been implicated in the present case due to village rivalry and personal animosity. It is further submitted that the allegations against the petitioner are general and omnibus in nature and no specific overt act has been attributed to the petitioner and in fact the informant is not an eye-witness to the actual occurrence and In the FIR the informant himself stated that when he reached the place of occurrence, he merely saw the accused persons fleeing

Thus, the prosecution has wrongly attempted to project the informant as an eye-witness. It is lastly submitted that the petitioner has clean antecedent and has been languishing in jail since 29.01.2026.

4. Learned APP for the State has opposed the prayer for bail of the petitioner.

In the facts and circumstances of this case, and considering the statements made in the petition as well as the above submissions, coupled with the petitioner's period of custody, the completion of the investigation against him, and the fact that the informant implicated the petitioner merely on account of seeing him fleeing from the alleged place of occurrence, this Court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Basantpur (Lakri Nabiganj O.P.)
