JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Araria P.S. Case No.177 of 2020 (G.R. No.718 of 2020) for the offence under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he was involved in theft of the motorcycle. He further submits that the petitioner was neither named in the FIR nor any incriminating article has been recovered from his possession. Petitioner is in custody since 18.05.2020.

Considering the period of custody of the petitioner, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds
