====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 31-08-2022 Heard Mr. Kiran Kumari Sharma, learned counsel appearing on behalf of the petitioner and Mr. Dinesh Singh, learned A.P.P. for the State.

Petitioner, who is in custody since 24.03.2021, seeks regular bail in connection with Phulwari Sharif (Janipur) P.S. Case No. 509 of 2020 dated 19.09.2020 registered for offences punishable under Sections 395 of the Indian Penal Code. It is submitted on behalf of the petitioner that taking into consideration the nature of allegation and other co-accused persons against whom similar allegation has been made in the F.I.R. have already been released on bail but so far as the present petitioner is concerned, several cases are pending against him and she has no knowledge as to whether in how many cases the petitioner has been convicted or acquitted and in that view of the matter it would be proper that the trial of the present case against the petitioner may be concluded within any reasonable period of time.

Patna High Court CR. MISC. No.32487 of 2022(2) dt.31-08-2022 2/2 Learned A.P.P. has no objection.

Taking into consideration that similarly situated coaccused persons namely, Rahul Kumar has already been granted bail vide order dated 20.04.2022 passed in Cr. Misc. No. 55385 of 2021, Pardeshi Kumar has already been granted bail vide order dated 25.03.2022 passed in Cr. Misc. No. 50183 of 2021 and Nitish Kumar and Prakash Chandra Upadhyay have already been granted bail vide order dated 31.03.2022 passed in Cr. Misc. No. 44757 of 2021 and taking into consideration the criminal antecedent of the petitioner this Court appreciates the submission made by learned counsel for the petitioner and directs the learned Court below to conclude the trial within a period of nine months.

Superintendent of Police, Patna is directed to produce all the prosecution witnesses on each and every date fixed by the learned trial Court.

Accordingly, the present bail application is disposed of.
