2. The petitioner seeks bail in a case registered for the offence punishable under Sections 384, 379, 341, 323, 325, 504, 506, 34 of the Indian Penal Code.
3. The allegation in the First Information Report is that the accused persons including the petitioner came to the shop of the informant and demanded extortion money of Rs. 10,000/-. It is further alleged that the petitioner Sonam Kumar abused him and assaulted him on the head of the informant with the butt of the gun due to which, he fell down. Patna High Court CR. MISC. No.32965 of 2025(2) dt.22-05-2025 2/3 snatched away golden chain and ring from him and further both the accused persons had assaulted him with rod and butt of pistol on his head and body and he was severely injured.

Learned counsel for the petitioner submits that it would appear from the First Information Report itself that there is general and omnibus allegation of demanding of money and the specific allegation on the petitioner is with regard to assaulting the informant by means of butt of the pistol on his head. However, it is shown from Annexure-4 series annexed to the present application which is the injury report that no injury has been found on the head of the deceased and one abrasion, which is on the lips on the right side of the face, has been found to be simple in nature and the final injury report is also on record which would also show that nature of injury is simple.
It has further been submitted that the co-accused Agam Kumar upon whom also the allegation is of assault and of snatching the chain has been granted anticipatory bail by the learned court below itself vide Annexure-5 to the application. The present petitioner was also granted the benefit of Section 41(a) Cr.P.C. and there is no allegation of him having misused the said benefit. Now the petitioner is in custody since 03.01.2025 and charge-sheet has been submitted.

Patna High Court CR. MISC. No.32965 of 2025(2) dt.22-05-2025 3/3 the informant have opposed the application for bail, besides others, on the ground that the petitioner has criminal antecedents. In response to the same, learned counsel for the petitioner submits that the petitioner is on bail in all the cases.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ghosi P.S.
