1. This Court has passed a detailed order dated 10.05.2024. On the said date the learned counsel for the petitioner undertook to file typed copies of the Annexures which are not eligible and the learned counsel for the respondents also contended that the writ petition itself is not maintainable in view of the judgment of the Apex Court in Reliance Life Insurance Company Limited and another Vs. Rekhaben Nareshbhai Rathod.

2. Inspite of the said order, the learned counsel for the petitioner has not filed any typed copies of the Annexures.

3. Further, an adjournment was sought in the case on the

Patna High Court CWJC No.2063 of 2016(9) dt.15-07-2024 2/2 ground that senior counsel would appear to pursue the matter.

4. On perusal of the Apex Court judgment i.e. Reliance Life Insurance Company Limited and another Vs. Rekhaben Nareshbhai Rathod, it is evident that alternative remedy is available for the petitioner to seek remedy before the Consumer Forum as has been settled by this Court in a number of orders of the Division Bench and Single Bench. Reference in this connection may be usefully made to Division Bench judgment of this Court in the case of M/s Messina Beej Pvt. Ltd. Vs. New India Assurance Comp. Ltd. & Ors., reported in 2011(1) PLJR 646, which is being followed invariably including a Bench order dated 07.07.2014 in C.W.J.C. No. 6068 of 2014.

5. That being so, writ petition is wholly misconceived and ill-advised and is, accordingly, dismissed as devoid of merits.

6. Dismissal of this application/writ petition, however, will not come in the way of the petitioner in taking appropriate legal remedy which is available to the petitioner in accordance with law.
