The petitioner seeks bail in anticipation of his arrest in connection with Baikunthpur P.S. Case No. 170 of 2017 instituted for the offences under Sections 25(1-b)a & 26 of the Arms Act.

The allegation against the petitioner is of having provided shelter in a public building to one Mukesh Patel, from whose possession, firearm weapon has been recovered.

No.33076 of 2020(2) dt.10-03-2021 2/3 Learned counsel for the petitioner has submitted that he holds no public post and has no authority of any kind whatsoever over a public building. The accusation against the petitioner is highly unfounded and without any basis. The petitioner earlier was made accused in three other criminal cases but in all such cases, his implication was not by naming him. In all the three cases referred to in paragraph -3 of the bail petition, he has been granted bail.

Since nothing has been recovered from his possession and he is only alleged to have allowed Mukesh Patel to stay in a public building to evade arrest, which allegation does not appear to be meaningful, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Gopalganj, in connection with Baikunthpur P.S. Case No.
