In this case, the petitioner is seeking anticipatory bail in connection with Fatuha P.S. Case No.714 of 2018, registered for the offence under Section 302/34 of the Indian Penal Code.

In the F.I.R., it has been alleged that while the informant was coming to her house she saw that the petitioner and other accused persons were coming out from the house and after seeing the informant they fled away. When the informant entered into the room, her husband was found dead. The statement with regard to death can be corelated with the inquest report as well as postmortem report.

Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
