2. The petitioner seeks regular bail in connection with Bettiah (Town) P.S. Case No. 32/2026, lodged on 18/01/2026, under Sections 8, 20(B)ii(C) of the NDPS, 1985.

3. As per the prosecution case, the total recovery of 138.261 Kg of cannabis has been the subject matter of the present case. The said cannabis has been recovered from a vehicle (Baleno Registration No. BRCS4363) and petitioner's adhaar card and pan card has also been recovered from the said vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further

He further submits that at the time of the recovery, the persons other than the petitioner were arrested and on whose confession name of petitioner has figured in this case. Learned Counsel further submits that in the FIR itself the name of the owner of the vehicle registered before the Transport Department has been indicated. He further submits that in spite of the fact that the alleged recovery has not been made from the possession of the petitioner only on the basis of suspicion, he is in languishing in jail about six months. He further submits that the antecedent of the petitioner is clean. However, the petitioner is willing to abide by any conditions that may be imposed by this Hon'ble Court in the event of his release on bail.

5. Learned counsel for the State opposes the prayer for bail and submits that the vehicle actually belongs to the present petitioner. Though in the record of the Transport Department, it is registered in the name of other person but it has been sold by third hand and present owner at the time of the occurrence is the present petitioner. Learned Counsel further submits that petitioner has been arrested and his pan card and adhaar card have also been recovered in the vehicle in which the

6. In the present facts and circumstances, I am not inclined to grant regular bail to the petitioner at this stage.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Bettiah (Town) P.S. Case No. 32/2026, pending before the learned Exclusive Special Judge, Bettiah, West Champaran,is hereby rejected.
