The petitioner seeks bail in anticipation of his arrest in connection with Balmikinagar P.S. Case No. 09 of 2018 dated 23.01.2018 instituted for the offences under Sections 30(a), 38(i) of the Bihar Prohibition and Excise Act, 2016.
It appears that petitioner was found running away after leaving behind 250 liters of locally brewed liquor.
Learned counsel appearing for the petitioner has submitted that the recovery appears to have been made from deep forest and the petitioner has wrongly been named as the person running away from the aforesaid place where the liquor was left behind. The
Patna High Court Cr.Misc. No.66439 of 2018(2) dt.14-12-2018 2/2 petitioner does not have any criminal antecedent. For the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, West Champarn, Bettiah in connection with Balmikinagar P.S. Case No. 09 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
