The petitioners have filed the instant application for grant of anticipatory bail in connection with Shambhuganj P.S. Case no. 73 of 2020 registered under sections 307, 354B, 147,
Patna High Court CR. MISC. No.31572 of 2020(3) dt.02-03-2021 2/3 341, 323 and 506 of the Indian Penal Code.
As per allegation in the F.I.R., 14 named accused persons including the petitioners herein are said to have assaulted the informant and others.
It is submitted by learned counsel for the petitioners that there is case and counter case between the parties, the correct version having been narrated in the F.I.R. at Annexure-2 lodged by the son of petitioner no. 8. It is submitted that the allegations are general and omnibus in nature and all the injuries except one, which is not attributable specifically to any petitioner, are simple in nature. The petitioners have no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the submissions made on behalf of the petitioners, this Court is inclined to enlarge the petitioners on anticipatory bail. The petitioners above named, in the event of their arrest or surrender in the Court below within a period of six weeks from today in connection with Shambhuganj P.S. Case no. 73 of 2020 are directed to be enlarged on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No.31572 of 2020(3) dt.02-03-2021 3/3 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Banka, subject to the conditions as laid down in section 438(2) of Criminal Procedure Code.
