2. The petitioners seek bail in connection with Karnamepur P.S. Case No. 14 of 2026 registered for the offence under Sections 115(2), 126(2), 70(2), 3(5) of the BNS 2023 and under Sections 4 and 6 of the POCSO Act.

3. As per the prosecution case, the accused persons are said to have committed rape with the minor victim.

4. The petitioners are in custody since 16.02.2026.

5. Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case.

6. Learned APP for the State has opposed the application of the petitioners.

7. From the statement of the minor victim girl, it

Patna High Court CR. MISC. No.33553 of 2026(3) dt.14-07-2026 2/3 appears that the rape was committed by one Jitendra Yadav with the help of Ashok Yadav (petitioner no. 02). The petitioner no. 01 is the owner of Orchestra in which the minor girl, aged about 14 years, was working.

8. Considering the allegation levelled against the petitioner no. 01 that he is not involved in committing rape with the minor victim and he is only alleged to be the owner of the orchestra, this application is allowed with regard to him.

9. Let the petitioner no. 01, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Karnamepur P.S. Case No. 14 of 2026.

10. So far as the allegation levelled against the petitioner no. 02, this court is not inclined to grant bail to him.

11. Accordingly, this application is allowed with regard to petitioner no. 01 and dismissed with regard to petitioner no. 02.

12. As a condition of this order, the petitioner no. 01, at the time of furnishing the bail bonds will give an affidavit that he will not involve himself in the business of orchestra in future. If it is found that the petitioner no. 01 is involved in the
