18-02-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Complaint Case No. 738C of 2018 registered for the offence under Sections 498(A)/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Vide order dated 16-08-2019, the matter was sent to Mediation Centre for resolving the dispute. Thereafter, a report dated 26-11-2019 has been received from the Mediator at Flag 'C', which reveals that dispute between the parties has been resolved, in terms of settlement annexed therein. Considering the aforesaid facts and circumstances, in the event of his arrest/surrender within a period of six weeks

Patna High Court CR. MISC. No.30390 of 2019(5) dt.18-02-2020 2/2 from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Complaint Case No. 738C of 2018 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
