JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim has renewed his prayer for bail in a case registered for the offences punishable under Sections 498A,304B and 120B/34 of the Indian Penal Code. The accusation is of inflicting torture and consequently killing the daughter of the informant after one year of marriage for non fulfillment of dowry demands.

In pursuance to the order of this court dated 19.8.2015, the Superintendent of Police, Rohtas is present with show-cause. Perused the show-cause. It reflects that all the chargesheeted witnesses except Chandrawati Devi, wife of Sudarshan Sharma, have already been examined though

Patna High Court Cr.Misc. No.34210 of 2014 (5) dt.16-09-2015 2/2 Chandrawati Devi was produced before learned trial court on 1.9.2015 and 11.9.2015 but the learned trial court could not examine the said witness.

It is submitted by the learned counsel for the state that next date fixed in the trial is 19.9.2015 when Chandrawati Devi will be produced for her examination.

Considering the present stage of the trial, this court is not inclined to revise the earlier order. The prayer of the petitioner for grant of bail is rejected in connection with Darigaon P.S. Case No. 241 of 2012 (S.T. No. 318 of 2012) pending in the court of learned Additional Sessions Judge V, Rohtas at Sasaram. It is expected from the learned trial court to examine Chandrawati Devi on the next date fixed and conclude the trial expeditiously.

The personal appearance of the Superintendent of Police, Rohtas is dispensed with.
