JUSTICE PRABHAT KUMAR JHA ORAL ORDER 15-04-2019 The appeal has already been dismissed against Respondent No.5 and heirs of Respondents No.1, 3, 6 and 7 due to non-compliance of the order dated 17.05.2018. The plaintiff filed the suit for declaration of right, title and interest over the suit lands against the defendants. The suit was allowed. The defendant filed appeal and the first appellate court allowed the appeal and dismissed the suit. Appellants are the plaintiffs. Same and similar prayer for declaration of right and title has been sought against all the respondents but due to noncompliance of the peremptory order, the appeal had been dismissed against Respondent No.5 and heirs of Respondents No.1, 3, 6 and 7. To avoid the contradictory judgments, the appeal as a whole shall stand dismissed.
