The petitioner seeks bail in anticipation of his arrest in connection with Tribeniganj P. S. Case No. 104 of 2018 dated 16.03.2018 instituted for the offences under Sections 147, 148, 149, 341, 323, 332, 333, 307, 353, 504, 427 and 431 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that because of the murder of a person, the irate mob blockaded the road. Around 17 persons have been named in the F.I.R. and about 300-400 other persons are alleged to have participated in the occurrence.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.66476 of 2018(2) dt.14-12-2018 2/2 that the petitioner has not been named in the F.I.R. and his name has come in the confession of one of the accused persons.
It has also been submitted that under similar circumstances many such accused persons have been granted bail by different Benches of this Hon'ble Court. Regard being had to the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Supaul in connection with Tribeniganj P. S. Case No. 104 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
