Mr.Raj Ballabh Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 15-05-2019 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Kawakole P.S. Case No. 62/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that on the date of occurrence on getting secret information police party reached at the place of occurrence and saw two persons carrying plastic bags over their head. Seeing the police party they started running away after throwing the bags but on chase they were arrested, who disclosed their name as petitioners. Petitioner no. 1 disclosed that he was having 40 litres of country made liquor

Patna High Court CR. MISC. No.32385 of 2019(2) dt.15-05-2019 2/2 and petitioner no. 2 disclosed that he was having 24 litres of illicit liquor.

Petitioners are in custody since 13.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Nawada, in connection with Kawakole P.S. Case No. 62/2019, subject to the conditions that both the bailors shall be the close relative of the petitioners.
