JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-01-2022 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and Mr. Ram Naresh Ray, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Rail Thana Mokama PS Case No. 20/2021 registered for the offence punishable under Section 379 of the IPC.
As per First Information Report, a trolley bag of the informant was stolen from the train containing valuables and the same was recovered from the hotel jointly owned by the petitioner.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case mainly on the basis of the fact that he happens to be co-owner of the said hotel in which the accused persons had stayed as customers and from their possession certain stolen articles were recovered. Patna High Court CR. MISC. No.42057 of 2021(2) dt.31-01-2022 2/2 counsel further submits that petitioner is not an accomplice of the accused persons from whose possession the stolen articles have been recovered and on the basis of the allegation levelled against the petitioner, at best, offence under Section 212 CrPC will be attracted and the petitioner is in custody since 19.04.2021. Charge-sheet has already been submitted in the matter.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 19.04.2021, petitioner is the co-owner of the hotel in which the accused persons had stayed, charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, BACHU SINGH @ BACHHU SINGH @ CHANDAN KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with Rail Thana Mokama PS Case No. 20/2021.
