2. These are the first bail applications for grant of anticipatory bail of the petitioners apprehending their arrest in connection with Hussainganj P.S. Case No. 101 of 2024 registered for the offence under Section 379 of the Indian Penal

Patna High Court CR. MISC. No.12063 of 2025(4) dt.13-08-2025 2/3 Code. Both the bail applications are related with the same P.S., therefore, both the petitions are being heard together and is disposed of by this common order.

3. According to the case of prosecution, it is alleged that on 10.03.2024 at night some unknown persons were stolen the tractor and trolley of the informant from his factory. The said tractor has been seized on 03.06.2024 from the possession of co-accused Mannu Kumar and Sawan Kumar Yadav. In their confessional statement, they have disclosed the name of the present applicants.

4. Learned counsel for the petitioner submits that petitioners are innocent and have falsely been implicated in the present case. There is no legal evidence available on record to implicate them for the alleged crime in question. The seized vehicle is also seized from the possession of co-accused Mannu Kumar and Sawan Kumar Yadav. Therefore, on this ground alone the petitioners are entitled to get benefit of anticipatory bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioners.

Considering the submissions made by the counsel for the petitioners and particularly considering the fact that the names of the applicants have been disclosed by the co-accused persons in their confessional statement without commenting any merit of the case, I am of the view that it is a case where the petitioners should be granted benefit of anticipatory bail.

9. Accordingly, the application is allowed.

Let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IX, Siwan in connection with Hussainganj P.S. Case No. 101 of 2024, subject to the condition as laid down under Section 482(2) of B.N.S.S. 2023.
