The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 386, 504, 506, 34 of the Indian Penal Code and Section 27 of the Arms Act. It is a case of assaulting due to which the informant sustained injuries. It is alleged against the petitioner that he assaulted with the butt of the pistol to the informant.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.32926 of 2022(2) dt.28-11-2022 2/2 petitioner that in the background of some land dispute, the present F.I.R has been registered. There is no accusation of repeating the blow. Moreover, the injury of the informant has been found to be simple in nature. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Siwan in connection with G.B. Nagar P.S. Case No. 129 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
