Earlier prayer for bail of the petitioner was refused by this Court vide order dated 22.10.2019, passed in Cr.Misc.No. 41393 of 2019.

Learned counsel for the petitioner submits that the charges have already been framed against the petitioner and other accused persons. Other similarly situated co-accused Praveen Kumar Sharma @ Praveen Kumar Singh has already been allowed bail by a co-ordinate bench of this Court vide order dated 12.7.2018, passed in Cr.Mis.No.22844/2018. Petitioner is in custody since 22.11.2017.

In the facts of the case, prayer for bail of the petitioner

Patna High Court CR. MISC. No.33012 of 2020(3) dt.17-02-2021 2/2 is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court of Special Judge, Vigilance 1st, Patna in Special Case No. 349 of 2017/Gandhi Maidan Police Station Case No. 515 of 2017 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his/her absence on two consecutive dates without sufficient reason, his/her bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
