JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 448, 341, 323, 354(B), 427, 506, 504/34 of the Indian Penal Code.

As per prosecution case, all the co-accused persons including the petitioner assaulted the informant and his family members by means of iron rod.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner and the informant reside adjacent to each other and due to dispute over throwing of drainage water a simple altercation took place between the parties in which both sides sustained injury. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sheikhpura in Sheikhpura (Hathiyawan O.P.)
