JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 The petitioner being husband of the victim is languishing in custody since 18.02.2014 in a case registered for the offences punishable under Sections 302, 201, 34 of the I.P.C.

On recovery of a dead body being not identified by anyone the F.I.R was lodged against unknown. Subsequently the mother and sister of the victim identified the victim through her clothes when it was found that petitioner is husband of the victim.

It is submitted by learned counsel for the petitioner that victim went missing on 12.01.2014 and thereafter the petitioner was searching her and ultimately he was arrested on 18.02.2014. The identity of the victim has not been made and only on suspicion it is claimed that victim was the wife of the petitioner.

Patna High Court Cr.Misc. No.33501 of 2014 (3) dt.27-01-2015 2/2 Considering the fact that petitioner took no initiative to lodge any case when his wife went missing, this Court is not inclined to grant bail to the petitioner at present. However, petitioner will be at liberty to renew his prayer for bail, if the trial will not be concluded within a period of one year. It is expected from learned Court below to expedite the trial.

Accordingly the application is dismissed in connection with Sessions Trial No. 424 of 2014, arising out of Ghora-Sahan P.S. Case No. 19 of 2014.
