This application for anticipatory bail arises out of Sirdala P.S. Case No. 21 of 2019 for the offence punishable under Sections 341, 323, 504, 354, 308 and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners has submitted that the informant and the petitioners are agnates and live in different parts of the same house. It is alleged in the First Information Report that persons, named in the First Information Report, entered into the informant's house, abused him and assaulted his daughter. It is being argued that till date no evidence of any injury on the informant or her daughter has come to fore. According to him, it is the dispute in the

Patna High Court CR. MISC. No.29787 of 2019(2) dt.07-05-2019 2/2 family, which is the reason behind lodging of the present false First Information Report.

Be that as it may, in the background of nature of allegation, this application deserves to be allowed and is accordingly allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Nawada, in Sirdala P.S. Case No. 21 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
