25-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Kadwa (Dholbajja) P.S. Case No. 8 of 2021, registered for the offence under Section 8 (c)/ 22(b) of the N.D.P.S. Act.

1600 bottles of 100 ml. cough syrup were recovered from Bolero vehicle of this petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is a businessman and runs a Medical shop in the name of Maa Kali Medical Agency, having license issued by the Drug Controller, Saharsa, valid till 21.06.2023. The cough syrup in question was purchased from Hindustan Medical Agency after paying a sum of Rs. 74,117/- including CGST & SGST and the same was being carried by his Bolero vehicle, in the meantime, officer of Drug Department seized the same and lodge a false

Patna High Court CR. MISC. No.41951 of 2021(2) dt.25-10-2021 2/2 case against this petitioner. Petitioner has got clean antecedent and he is in custody since 24.01.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody and clean antecedent of petitioner, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-10, Bhagalpur in connection with Kadwa (Dholbajja) P.S.
