JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-12-2020 In view of the submission and undertaking of the learned counsel for the petitioner, at the time of hearing of this application, through Video Conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 24.11.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.
Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with Paroo P.S. Case No.106 of 2019 registered under Section 379 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that regarding the theft of the motorcycle of the informant Mukesh Kumar on 17.03.2019 at
Patna High Court CR. MISC. No.31720 of 2020(2) dt.04-12-2020 2/2 about 09.00 P.M., the present case was instituted under Section 379 of the Indian Penal Code on 18.03.2019 against three unknown. In course of investigation, some accused were apprehended by the police in connection with the present case, whose confessional statement was recorded, in which they disclosed the involvement of the petitioner in the present case. Thereafter, the petitioner was remanded in the present case on 23.05.2019 because the petitioner is accused in two other cases, as detailed in paragraph-3 to this application, in which he is on bail. In the present case, the petitioner is in custody since 23.05.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III (West)-cum-Sub Judge, Muzaffarpur, in connection with Paroo P.S.
