The petitioner apprehends his arrest in Warisaliganj P.S. Case No.109 of 2019 registered under Section 30(a) of Bihar Prohibition and Excise Act.

The informant, S.H.O. of Warisaliganj P.S. disclosed in his written report that while he was on patrolling duty and vehicle checking, one motorcyclist started fleeing away. On chase, the motorcyclist was apprehended. The motorcyclist disclosed his name as Deonandan Prasad. From the dickey of motorcycle, 8 bottles each containing 375 ml. Imperial Blue Whiskey was recovered. On the disclosure made by Deonandan Prasad, 12 bottles of Imperial Blue Whiskey, 40 bottles of Kingfisher Strong Premium Beer and 6 Cane of Beer were

Patna High Court CR. MISC. No.31046 of 2019(2) dt.10-05-2019 2/2 recovered from a wheat field situated near the Water Tonkey of the village. Deonandan Prasad disclosed that petitioner is also involved with him in illegal trade of liquor. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner save and except the fact that apprehended accused disclosed the name of the petitioner. Nothing has been recovered from the house of the petitioner or any place belonging to the petitioner and petitioner has got no criminal antecedent.

Taking into consideration the facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II-cum-Special Judge, Nawada in connection with Warisaliganj P.S. Case No.109 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
