The petitioner apprehends his arrest in connection with Excise Case No. 172 of 2019, registered for the offences punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.
This is the second attempt on behalf of the petitioner for grant of anticipatory bail. Earlier, the prayer for anticipatory bail of the petitioner was dismissed as withdrawn, vide order, dated 09.07.2019, passed in Criminal Misc. No. 42417 of 2019. The allegation, as per the prosecution report, is that the Excise officials recovered a total quantity of 107.16 litres of illicit liquor from the paddy house of the petitioner.
Patna High Court CR. MISC. No.36166 of 2020(2) dt.27-01-2021 2/2 Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique motive. He further submits that the paddy house of the petitioner is situated outside of his house and the same is accessible to all and sundry.
After having heard learned Counsel for the parties and taking into consideration the fact that earlier, the anticipatory bail application of the petitioner was dismissed as withdrawn and the present anticipatory bail application has been preferred by the petitioner without any subsequent development in the matter, I am not inclined to entertain this second anticipatory bail application.
This application is, accordingly, dismissed.
