The petitioner seeks bail in connection with Uchakagaon P.S. Case No. 94 of 2019 for the offence under Sections 395 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by a co-ordinate Bench of this Court vide order dated 06.02.2020 passed in Cr. Misc. No. 57606 of 2019. Now the prayer for bail of this petitioner has been renewed on the ground of custody as the petitioner is languishing in judicial custody since 10.04.2019 i.e. more than one and half

Patna High Court CR. MISC. No.31046 of 2020(2) dt.22-12-2020 2/2 year and the likelihood of conclusion of trial is not expected in near future. Therefore, petitioner may be enlarged on bail. Learned counsel for the petitioner further submits that the present case is pending before the learned Additional Sessions Judge-I, Gopalganj whereas in the satisfaction portion of the petition, learned Chief Judicial Magistrate, Gopalganj has been typed. Hence, necessary correction may be accepted to the aforesaid extent only. In view of the submission, necessary correction to the aforesaid extent is accepted.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Additional Sessions Judge-1, Gopalganj in connection with Uchakagaon P.S. Case No. 94 of 2019.
