JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 3.5.2014 in a case registered for the offences punishable under Sections 420,467,468 and 471 of the Indian Penal Code. It is alleged against the petitioner that he opened a joint account with Ram Nath Sharma in Indusind Bank and transferred the amount from ICICI bank of Ram Nath Sharma to the joint account of Indusind Bank which was subsequently withdrawn by the petitioner.

It is submitted by the learned counsel for the petitioner that the petitioner took a loan of Rupees thirty two lacs twenty four thousand from Ram Nath Sharma which was being

It is submitted by the learned counsel appearing on behalf of Ram Nath Sharma that the amount which was withdrawn from Indusind Bank by the petitioner to tune of Rupees eighteen lacs has not been returned by the petitioner. It is submitted by learned counsel for the petitioner that inspite of return of rupees thirty two lacs twenty four thousand by the petitioner, the security amount were not returned by Ram Nath Sharma for which a legal notice was transmitted but no reply was made.

Considering the accusation in the backdrop of business relationship between the petitioner and Ram Nath Sharma and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur in connection with Rupaspur P.S. Case No. 119 of 2013.
