The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,379,353,427 and 504/34 of the IPC.
The prosecution case as per the written report of Rupam Kumari dated 22.5.2018 submitted to the SHO, Amarpur is to the effect that on the same day at 1 P.M. a meeting for constitution of School Education Committee was being conducted at Middle School, Rajpur. Since there was no selection from the school, the petitioners made protest, assaulted the informant and snatched the files.
It is submitted by learned counsel for the petitioners that for a dispute with regard to constitution of committee, the
Patna High Court Cr.Misc. No.65428 of 2018(2) dt.13-12-2018 2/2 accusation has been levelled. There is counter version of the occurrence ventilated through Complaint Case No. C681 of 2018. It is further submitted that in fact, there was only hot exchange between the informant and petitioners. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.
Considering the genesis of the occurrence, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Banka in connection with Amarpur P.S. Case No. 263 of 2018 subject to the conditions laid down in Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) anil/- U
