====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 325, 307, 379, 504 and 506 of the Indian Penal Code. The informant alleges that accused persons came to his house and on orders of Vishwanath, Hemant caught the informant and Prince assaulted him with gadasa causing injury on head, thereafter, Shambhu assaulted by an iron rod causing injury on leg, it is next alleged that Vishwanath assaulted Nidhi by an iron rod causing injury on her forehead and also assaulted Ashok, thereafter, petitioner along with Vishwanath also assaulted Ashok by an iron rod, thereafter Hemant and Prince snatched Rs. 45,000/-.

No.32956 of 2022(2) dt.23-11-2022 2/2 Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that informant has received three injuries out of which one injury on head is grievous but then allegation of assaulting the informant on head is against Prince and as far as this petitioner is alleged, he is alleged to have assaulted the informant on leg and the injury is simple. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Majhauliya P.S. Case No. 616 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) GauravSinha/- U T
