====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 07-07-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The present Cr. Misc. Application has been filed for quashing the order dated 19.09.2018 passed by the learned Additional and District Sessions Judge, 8th, East Champaran, Motihari in Session Case No. 590 of 2018 (arising out of Tirkuliya/Raghunathpur P.S. Case No. 15 of 2017).

3. As per the report of the Trial Court dated 17.04.2026, out of 8 prosecution witnesses, three witnesses have been examined and the case is pending for further prosecution evidence.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.65690 of 2018(5) dt.07-07-2026 2/2 present application may be disposed of with liberty to the petitioner to take all the points, as raised in this petition, before the learned Trial Court at appropriate stage in accordance with law.

4. Learned A.P.P. for the State has no objection to this prayer of the petitioner.

5. Considering the submissions of learned counsel for the parties, this case stands disposed of with liberty to the petitioner, as prayed for.
