The petitioner seeks pre-arrest bail in connection with Bibhutipur P.S. Case No.125 of 2017 registered under Sections 406, 420, 467, 504 and 120B of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that initially a complaint was filed which got dismissed and after about six months of dismissal of the complaint another complaint was filed which was referred to the police for investigation pursuant to which the instant FIR has been instituted. It is further contended that two other coaccused, namely, Arun Kumar Sinha and Smt. Meena Singh @ Meena Sinha have already been granted pre-arrest bail by a Bench of this Court vide order dated 14.12.2018 passed in Cr.

Patna High Court Cr.Misc. No.68877 of 2018(2) dt.19-12-2018 2/2 Misc. No.67810 of 2018.

Considering the nature of allegation and the submissions made above, in the event of arrest or surrender before the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Rosera, Samastipur in connection with Bibhutipur P.S. Case No.125 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
