The petitioner seeks regular bail in connection with Cheriya Bariyarpur P.S. Case No. 118 of 2011 for the offence registered under Section 302 and other allied sections of the Indian Penal Code and Section 27 of the Arms Act. The informant named 14 persons and it is alleged that on the order of Maharaji Sahani, Laxmi Sahani fired which hit on the waist of Allauddin and other accused persons also

Patna High Court Cr.Misc. No.34372 of 2014 (3) dt.13-01-2015 2/2 fired. The other accused persons also assaulted Sipahi Paswan. It is alleged that Jhari Sahani was kidnapped and he is still traceless. Allauddin and Sipahi Paswan died.

Learned counsel for the petitioner submits that other accused persons have already been enlarged on bail. There is no specific allegation of assault against the petitioner. On the other hand, learned counsel for the informant submits that the petitioner was absconding and his trial has already been separated.

Considering the facts aforesaid and the fact that the petitioner is in custody since 04-04-2014, the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Cheriya Bariyarpur P.S.
