JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 24-07-2024 Counter affidavit submitted by Respondent No. 3 shows that charge-sheet has been already filed on 11.07.2024, it further shows that initially final report has been prepared on 30.09.2023 and finally submitted before the concerned court on 11.07.2024 and for this required explanation has already been called from the concerned I.O.

2. Learned counsel for the petitioner submits that since, charge-sheet has been already filed therefore, the petition becomes infructuous. However, he submits that petitioner has applied for his appointment on compassionate basis therefore, this petition may be disposed of directing the concerned trial court to conclude the trial within any specific period.

3. Perusal of the final report shows that only nine witnesses are mentioned in the charge-sheet and further,

Patna High Court CR. WJC No.987 of 2024(3) dt.24-07-2024 2/2 considering the submission made by the counsel that petitioner has already applied for his appointment on compassionate basis the learned trial court is directed to expedite the trial and conclude it as early as possible probably within one year from today.

4. Accordingly, this petition is disposed of with aforesaid observation.
