Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.
Petitioner is father-in-law of the victim of dowry death. Husband of the victim is already in custody. There is allegation of demand of dowry and torture for the same. Learned counsel for the petitioner submits that the allegation is general and omnibus. The petitioner is victim of over implication. He is in custody since 24.03.2020. Investigation of the case against the petitioner is already complete.
Learned counsel for the informant opposed the prayer
Patna High Court CR. MISC. No.31176 of 2020(3) dt.08-01-2021 2/2 for bail.
Considering the lack of direct material that the victim was tortured soon before her death for non-fulfillment of dowry demand by the petitioner also, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Chenari Police Station Case No. 158 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
