JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 This is an application for grant of anticipatory bail in connection with Hajipur Complaint Case No. 2166 of 2018, disclosing offences under Sections 498A, 147, 323, 379, 504 of IPC and Section 4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be the husband of the informant of subjecting her to torture and harassment with respect to dowry and ousted her from the house.

Submission of the learned counsel for the petitioner is that all the allegation are false and concocted and he is still ready to keep her with dignity and care.

Heard learned A.P.P. as well as learned counsel for the

No.32427 of 2019(3) dt.01-08-2019 2/3 opposite party no.2 also, they have opposed the prayer for anticipatory bail on the ground that she is not ready to reside with him as petitioner had married with another lady. The above submission has been controverted by the learned counsel for the petitioner stating that she has definite instruction that petitioner has not married with anyone.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Vaishali at Hajipur, in connection with Hajipur Complaint Case No. 2166 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that if the opposite party no.2 produced any document that he has married with another lady, she is at liberty to move for cancellation of the bail bonds of the petitioner before the court below itself.
